**Foreign buyers can purchase beachfront property in Bahia on the same terms as Brazilians.** The challenge is the process: a CPF, independent due diligence, a sale agreement and deed in reais, ITBI, registry, federal coastal-land rules and moving funds from abroad. ## The legal process in 6 steps

1. **CPF** (Brazilian tax number). This is quick to obtain, including at a consulate.
2. **Offer and an optional reservation agreement**, with a refundable deposit.
3. **Due diligence** by an independent lawyer: the *matrícula*, liens, seller certificates, permits, environmental rules and marinha status.
4. **SPA** (private sale agreement), usually with a 10–25% non-refundable deposit.
5. **ITBI and the public deed** at a notary, typically 3 weeks to 2 months after the SPA.
6. **Registration** at the Real Estate Registry in Porto Seguro. This is the step that transfers legal ownership.

## Paying from abroad

The contract and deed must be in Brazilian reais. Funds are usually wired through an authorised Brazilian bank and registered as foreign investment with the Banco Central do Brasil. That registration protects your right to repatriate the capital and any gains later. Rental income of non-residents is generally taxed at 15% at source. Capital gains on a sale start at 15%, rising with the size of the gain. Confirm your own position with a tax adviser.

## Bahia-specific risks to check

- **Marinha land**: land within 33 m of the 1831 high-tide line is federal land, with annual fees and laudêmio.
- **Protected areas**: APP setbacks and the APA Caraíva-Trancoso rules limit what you can build.
- **Rural classification**: some plots are rural, which brings ITR tax and limits on foreign ownership.
- **Unregularised construction**: check that the built area matches the approved plans and the *habite-se*.
- **Coastal exposure**: assess erosion and cliff stability on sea-front plots.
