Beach Villa Due Diligence in Bahia: The 2026 Checklist
Short answer: Before you buy a beach villa in Bahia, have an independent lawyer check six things: title (the matrícula and the seller's certificates), federal coastal land (marinha/SPU), zoning and environmental rules (APP, the APA Caraíva-Trancoso), permits (approved plans and the habite-se), physical and coastal risk (erosion, cliffs, drainage) and income claims (actual rental records). Most problems in Southern Bahia come from unregularised construction and unclear coastal land status, not from fraud.
1. Title and the seller
- A full, recent certidão de inteiro teor da matrícula from the Real Estate Registry in Porto Seguro
- No mortgages, liens, seizures (penhoras) or usufruct on the record
- Seller certificates covering civil, federal, labour and tax lawsuits
- If the seller is a company, its corporate documents and the signing authority
- If the seller is married, spousal consent
- For larger plots, a boundary survey (georreferenciamento) that matches the matrícula
2. Marinha (federal coastal) land
Land within 33 metres of the 1831 mean high-tide line is terreno de marinha, administered by the SPU. Check:
- Whether any part of the plot is marinha land, and under which regime (occupation or aforamento)
- Whether the annual fees (taxa de ocupação or foro) are paid up to date
- The 5% laudêmio due on transfer, calculated on the SPU-assessed value, and who will pay it
3. Zoning and environmental rules
- Municipal zoning (Porto Seguro master plan) and whether the plot is classed as urban or rural
- Permanent preservation areas (APP): dunes, restinga, mangroves, riverbanks and cliff edges
- The rules of the APA Caraíva-Trancoso environmental protection area, where relevant
- For rural land, CAR registration (rural environmental registry) and any limits on foreign ownership
4. Permits and construction
- Approved architectural plans (alvará de construção)
- An occupancy certificate (habite-se) that matches the built area. Extensions without permits are common.
- Whether the construction is recorded on the matrícula (averbação)
- Property tax (IPTU) status
5. Physical and coastal exposure
- A survey of the structure, roof, pool and timber for salt-air corrosion and termites
- Coastal erosion history and the condition of any sea defences on beachfront plots
- Cliff stability and setbacks for cliff-top homes
- Drainage and flood paths in the rainy season (roughly April–July)
- Water source (well, municipal supply), septic system, power capacity and internet
6. Rental income and valuation
- At least two seasons of actual booking statements and payouts
- Occupancy and nightly rates by month, with high season shown separately (December–March, Carnival, July)
- Management fees, staff costs, maintenance and taxes. Rental income of non-residents is generally taxed at 15% at source.
- Comparable sales and an independent valuation for high-value assets
7. Paperwork before the money moves
- A CPF for each buyer
- A reservation agreement or SPA with clear conditions precedent, linked to the due diligence results
- A plan for remitting funds through an authorised bank and registering the foreign investment with the Banco Central do Brasil
- A budget for closing costs of about 6–9% (ITBI 3%, notary about 1.5%, registry up to 1.5%, legal fees 1–3%)
Red flags
- "The deed will be sorted out later," or the property is sold through a contrato de gaveta (an unregistered private contract)
- A built area much larger than the area recorded on the matrícula
- Possession rights only (posse), with no registered title
- A seller who resists independent legal review
- Rental income figures with no booking records behind them
