Can Foreigners Buy Beachfront Property in Bahia? Rules, Restrictions and Marinha Land

Written by João | Oct 12, 2026, 1:34:29 PM

Short answer: Yes. Foreigners can buy beachfront homes and land in Bahia on essentially the same terms as Brazilians, without residency or a visa. The main rules to check are: a Brazilian tax number (CPF); whether part of the property is federal marinha land (held through occupation or aforamento rights, with an annual fee and a 5% laudêmio on sale); limits on rural land for foreigners; environmental restrictions on the coast; and registering your funds with the Central Bank.

Who can buy

Foreign individuals and companies can buy urban residential property in Brazil, including beachfront houses, villas and condominium homes. You don't need to live in Brazil, and you can sign through a power of attorney.

The rules that matter on the coast

Marinha land (terreno de marinha)

Land within 33 metres of the mean high-tide line of 1831 belongs to the federal government and is administered by the SPU (Secretaria do Patrimônio da União). Private owners, Brazilian or foreign, hold occupation or aforamento rights rather than full ownership. You pay an annual fee, and a laudêmio of 5% of the SPU-assessed value is due on each transfer. It is common on the Bahia coast and workable, but it must be checked and priced in.

Rural land limits

Brazil restricts the acquisition of rural land by foreigners (Law 5.709/1971). Depending on the size of the plot, an acquisition may need approval from INCRA, and there are caps on the total share of a municipality's area held by foreigners. Many large plots around Trancoso are classified as rural, so your lawyer must confirm the classification on the matrícula. Property classified as urban is not affected.

Border zone

Extra restrictions apply within 150 km of Brazil's land borders. This does not affect the Bahia coast.

Environmental protection

Dunes, restinga, mangroves, riverbanks and cliff edges are permanent preservation areas (APP), and much of the coast between Trancoso and Caraíva is inside the APA Caraíva-Trancoso. These rules limit what can be built and apply to every owner.

What you need to buy

  1. CPF (Brazilian tax number), available through a Brazilian consulate or in Brazil.
  2. An independent lawyer to run due diligence on title, debts, permits, marinha status and zoning.
  3. Funds sent through an authorised bank and registered with the Banco Central do Brasil, so you can repatriate them on sale.
  4. Public deed (escritura) signed at a notary after paying ITBI transfer tax, then registration at the Real Estate Registry, which is what makes you the legal owner.

Budget about 6–9% of the price for closing costs. The full process is explained in our foreign buyer's guide to Bahia beachfront homes.

Frequently asked questions

Does buying property in Brazil give me residency?

Not automatically. Brazil has an investor residence route linked to qualifying real estate investment; confirm current thresholds with an immigration lawyer.

Can a foreign company buy property in Bahia?

Yes. Foreign companies can buy urban property; they need a CNPJ and a local representative. Rural land is subject to the same limits as for foreign individuals.

Is marinha land a reason not to buy?

No. Many good beachfront properties include some marinha land. The key is to know exactly how much, confirm the rights are registered with the SPU, and include the costs in your price.
